1. Acceptance of Terms

By accessing and using Benk UI ("Service"), operated by Exodus Labs, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this Service.

2. Description of Service

Benk UI provides a premium UI component library for Next.js and Figma. Our Service includes access to production-ready components, code snippets, design assets, and related documentation that you can copy and paste directly into your projects.

3. User Accounts

To access certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate and complete
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Some features of our Service are provided on a subscription basis. By subscribing, you agree to:

  • Pay all applicable fees as described in our pricing plans
  • Provide current, complete, and accurate billing information
  • Authorize us to charge your payment method on a recurring basis
  • Be responsible for all charges incurred under your account

Subscription fees are non-refundable except as required by law. We reserve the right to change our subscription plans or adjust pricing with 30 days' notice.

5. License and Usage Rights

Subject to these Terms, we grant you a non-exclusive, non-transferable, limited license to:

  • Access and use the components in your personal and commercial projects
  • Modify the components to suit your project needs
  • Use components in unlimited projects (based on your subscription tier)

You may not redistribute, resell, or sublicense the components as a standalone product or as part of a competing component library.

6. User Responsibilities and Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Redistribute or resell components as a competing product
  • Share your account credentials with unauthorized users
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer or attempt to extract the source code of our platform

7. Intellectual Property Rights

Our Intellectual Property

The Service, including its original content, features, functionality, and the Benk UI brand, are owned by Exodus Labs and are protected by international copyright, trademark, and other intellectual property laws.

Your Projects

You retain full ownership of the projects you build using our components. We claim no intellectual property rights over the applications you create.

8. Privacy

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

  • We do not warrant that the Service will be uninterrupted or error-free
  • We do not guarantee compatibility with all frameworks or environments
  • Components are provided for integration into your own projects
  • We are not responsible for issues arising from modifications you make

10. Limitation of Liability

To the maximum extent permitted by law, Exodus Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately, but you may continue to use components already integrated into your projects according to your license terms at the time of purchase.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. We will notify you of changes by email or through a prominent notice on our Service.

13. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration or in the courts of competent jurisdiction.
